Summary

1. Purpose and definitions

These Terms of Service (hereinafter “ToS”) govern access to and use of the Search Api service available at https://search-api.ovh.

“User”: any legal entity or individual acting in a professional capacity (agency, freelancer, company, etc.) who has subscribed to the service. “Service”: the Search Api API as defined below.

2. Service description

SearchAPI is an online service accessible via API that provides real-time Google Search results in a structured format (titles, links, snippets, images, news, videos, shopping, and more). The service is designed for professionals — developers, SEO teams, marketing agencies, and SaaS platforms — who want to integrate accurate search data directly into their applications, tools, or analyses.

3. Account creation and user obligations

Access to the service requires the creation of a user account. The user agrees to provide accurate information, maintain the confidentiality of their login credentials, and use the service in compliance with applicable laws and regulations. Any fraudulent, abusive, or unlawful use (e.g., spamming, unlawful data collection) may result in suspension or deletion of the account.

4. Subscriptions, billing, suspension, termination

The service is offered as a paid subscription managed via Stripe. Pricing and terms are indicated on the website at the time of subscription. Payment is required in advance for each subscription period. No prorated refunds will be made for a started period, except where required by law. Search Api reserves the right to suspend or terminate access in case of non-payment or violation of these ToS.

5. Right of withdrawal

In accordance with applicable legislation, the right of withdrawal does not apply to B2B relationships. The legal exceptions provided by the Consumer Code therefore do not apply to professional users.

6. Intellectual property

All content, interfaces, software, APIs, and databases related to the Search Api service are protected by copyright and remain the exclusive property of Paul Girard (sole proprietorship). Any unauthorized reproduction, distribution, or use is prohibited.

7. Responsibilities and limited warranties

Search Api makes every reasonable effort to provide a service that is available and consistent with its description. However, no absolute guarantee is given regarding the absence of errors, interruptions, or security flaws. Since SearchAPI data comes from third-party public sources, Search Api cannot guarantee its completeness, accuracy, or timeliness. The operator shall not be held liable for any indirect damage or data loss resulting from the use of the service.

8. Security, data, and GDPR

Use of the service involves the processing of certain personal data (account data, technical logs). For more information, please consult the Privacy Policy. Hosting is provided by OVH SAS (Roubaix, France). Appropriate technical and organizational measures are implemented to protect user data.

9. Termination

The user may terminate their subscription at any time via their customer area. Termination takes effect at the end of the current period. Search Api may also terminate an account in case of non-compliance with the ToS, with or without notice depending on the severity of the breach.

10. Governing law and jurisdiction

These ToS are governed by French law. Any dispute relating to their interpretation or execution shall be subject to the exclusive jurisdiction of the courts of Coutances, unless mandatory jurisdictional rules provide otherwise.
